Community Rules & Regulations

Drafted with reference to Florida Statutes Chapter 720 (the Homeowners' Association Act) and DBPR guidance

1. Authority & Purpose

  • These Rules are adopted under the authority of the Association's Bylaws and Declaration, and must be reasonable and relate to the use of the common areas, shared amenities, and Association operations, consistent with Florida Statutes Chapter 720.
  • As the master association, Lago Grande HOA's Rules govern the common areas, roadways, and shared facilities serving the Lago Grande sub-associations; they do not override the individual governing documents of each member condominium association.
  • Rules may not conflict with the Declaration, Articles of Incorporation, or Bylaws. Where a conflict exists, the governing document controls.
  • Copies of these Rules will be provided to all member associations and posted on this website.

2. Common Areas & Shared Facilities

  • Common areas, including the clubhouse and grounds, are for the use and enjoyment of owners, residents, and their accompanied guests across all member associations.
  • Posted hours and rules for the clubhouse and any recreational facilities must be followed at all times.
  • Furniture, equipment, and landscaping in common areas are Association property and may not be removed or altered by residents.

3. Roadways & Parking

  • Vehicles must be parked only in designated and assigned parking areas within each sub-association, and may not obstruct HOA-maintained roadways.
  • Commercial vehicles, trailers, boats, and inoperable vehicles may not be stored on HOA common property except as expressly permitted by the Board. See examples of commercial vehicles not allowed →
  • Guest parking is reserved for guests only and is not to be used for regular resident parking.

4. Pets

  • Pets must be kept in accordance with any pet restrictions in the Declaration and leashed at all times in HOA common areas.
  • Owners must immediately clean up after their pets in all common areas.
  • Pets may not be left unattended in HOA common areas or the clubhouse grounds.

5. Noise & Nuisance

  • Owners and residents shall not engage in activity in common areas that unreasonably disturbs the peaceful enjoyment of other residents.
  • Excessive noise in common areas, especially between 10:00 PM and 8:00 AM, should be avoided.
  • No activity that is a nuisance, hazardous, or in violation of any law or ordinance is permitted on HOA property.

6. Trash & Recycling

  • Trash and recycling in common areas must be placed only in designated collection areas.
  • Bulk items (furniture, appliances) must be scheduled for pickup and not left in common areas.
  • Recycling should be sorted per Miami-Dade County guidelines where bins are provided.

7. Alterations to Common Property

  • No member association or resident may alter, add to, or remove HOA common property, landscaping, or shared infrastructure without prior written Board approval.
  • Any work affecting shared roadways, drainage, utilities, or the clubhouse requires Board notification and approval in advance.

8. Assessments, Late Fees & Fines

  • Assessments are due as set by the Board's annual budget and are payable through the Association's designated payment channels.
  • Delinquent assessments accrue late fees and interest as permitted under the Declaration and Florida law, and may result in a claim of lien as provided under Chapter 720.
  • Before any fine is imposed for a rule violation, the owner will receive at least 14 days' written notice and the opportunity for a hearing before an independent grievance committee of at least three members (none of whom are Board members or reside with a Board member), as required by Section 720.305, Florida Statutes.

9. Records Access & Transparency

  • Owners may inspect the Association's official records within 10 business days of a written request, consistent with Section 720.303, Florida Statutes.
  • Certain records (attorney-client privileged material, personnel and medical records, and personal identifying information of other owners) are exempt from inspection.
  • The Board is committed to posting key documents on this website to promote transparency for all member associations and owners.

10. Meeting Notice

  • Board meetings will be noticed at least 48 hours in advance and posted conspicuously (and on this website's Calendar page where practical).
  • Annual meetings will be noticed at least 14 days in advance with an agenda; special assessment or rule-change meetings likewise require at least 14 days' notice.
  • All Board meetings are open to owners except where a specific exemption applies (e.g., meetings with the Association's attorney regarding proposed or pending litigation).

11. Amendment of These Rules

  • These Rules may be amended by the Board consistent with the authority granted in the Bylaws and Florida law, with notice to all member associations.
  • Any conflict between these Rules and a future amendment to the Declaration or Bylaws will be resolved in favor of the governing document.
